By accessing or using the Yowzzer website, platform, calculators, mobile tools, or reward programs (collectively, the “Services”), you accept and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use Yowzzer.

2. About Yowzzer

Yowzzer is a real estate rewards platform that connects buyers, sellers, licensed real estate agents, lenders, and home‑service vendors. We help reduce out‑of‑pocket costs and increase transaction engagement through cash‑back style credits and incentives funded by participating partners.

Yowzzer is a platform—not a brokerage. Real estate brokerage services are provided by licensed agents and brokerages. Lender services are provided by licensed mortgage professionals. Vendor services are provided by independent third parties.

3. Rewards Overview

Qualified users may earn rewards funded by partner contributions. Reward types include buyer task rewards, buyer closing bonuses, seller task rewards, seller closing credits, lender credits, and vendor‑funded incentives. All rewards are subject to: eligibility, successful closing where required, state law, lender/broker approval, and verification by Yowzzer.

Reward amounts shown on the site (tables, calculators, examples) are estimates. Actual reward amounts depend on the transaction value, commission earned, partner participation, and program compliance.

4. Buyer Rewards

  • Must work with a Yowzzer Partner Agent to qualify for full program rewards.
  • Agent contributes 15% of their gross commission earned on the buyer side to fund rewards.
  • Buyer Task Rewards: up to $825 for completing qualifying activities (e.g., registration, pre‑approval, home tours, inspection uploads, education steps). If the 15% pool is smaller than $825, task rewards are capped at the pool.
  • Buyer Closing Bonus: any remaining amount from the 15% pool after task rewards are paid is applied as a closing credit (where allowed).
  • Rewards are typically credited on the Closing Disclosure / Settlement Statement; alternative methods may be used where state law limits rebates.
  • Maximum 3 verified home tours count toward task points (unless otherwise stated in your market).

5. Seller Rewards

  • Must list with a Yowzzer Partner Agent to qualify for full program rewards.
  • Agent contributes 15% of their gross listing commission to fund rewards.
  • Seller Task Rewards: fixed at $400 for completing listing‑related tasks (e.g., disclosures, media approval, pricing review, showing readiness steps).
  • Seller Closing Bonus: the remainder of the 15% pool after task rewards is applied as a closing credit to the seller or may be offered (in whole or part) as a buyer incentive—seller’s choice (subject to contract and law).
  • Some markets include optional title premium discounts or vendor savings; availability varies by state.

6. Lender Credits

  • When a buyer uses a Yowzzer Partner Lender, the lender may contribute an additional credit—commonly 1% of purchase price toward buyer closing costs (actual amount disclosed in lender agreement documents).
  • Lender perks may include free appraisal, closing cost credits, or contributions to the Yowzzer reward pool.
  • All lender credits are subject to underwriting, program guidelines, rate lock terms, and federal/state lending laws.

7. Vendor Participation

Home inspectors, title companies, warranty providers, movers, and other service vendors may list services or participate in pay‑per‑lead or subscription models. Vendor contributions may help fund buyer or seller rewards. Vendors are independent and responsible for their own licensing, insurance, and service quality.

8. Agent Participation & 15% Contribution

  • Agents joining Yowzzer agree to contribute 15% of gross commission actually earned on any Yowzzer‑referred transaction.
  • The 15% funds all applicable rewards (tasks + closing credits).
  • If transaction terms change (reduced commission, concessions), the contribution adjusts automatically; reward amounts scale down accordingly.
  • Agent must ensure credits appear on the closing statement (or alternative method where required).
  • Agents may not surcharge clients to offset their contribution.

9. Subscriptions & Fees

Agents and vendors may subscribe for lead access, premium placement, analytics, or marketplace tools.

  • Subscription Tiers: Plans such as Basic ($49/mo) and Pro ($99/mo) may apply; pricing subject to change.
  • Auto‑Renew: All subscriptions renew automatically each billing cycle unless cancelled.
  • Cancellation: Cancel anytime in your dashboard; renewals already processed are non‑refundable.
  • Usage Fees: Pay‑per‑lead or marketplace fees may apply and will be disclosed before acceptance.
  • Taxes: Applicable taxes are added where required.

10. Eligibility & Legal Limitations

  • Users must be 18 or older.
  • Minimum transaction values may apply (e.g., $200,000 for full buyer/seller rewards; lower values.
Minimum agent commission to fund full rewards: 1.5% (side) or higher; below that, rewards scale.
  • Rewards only available where allowed by state law. Some states restrict cash rebates or mandate.

11. User Responsibilities

  • Provide accurate account, property, and transaction information.
  • Use the platform honestly—no false check‑ins, staged photos, or duplicate submissions.
  • Disclose Yowzzer participation when required by contract, builder registration, or brokerage policy.

12. Verification & Fraud Prevention

Yowzzer may verify task completion through uploaded photos, EXIF location data, browser geolocation, agent confirmation, MLS data, or closing documentation. Fraudulent submissions may result in denial of rewards, account suspension, or legal action.

13. Regulatory Compliance

  • RESPA: Yowzzer rewards and partner contributions are structured to comply with the Real Estate Settlement Procedures Act and related anti‑kickback provisions. Compensation is tied to disclosed services, not unlawful referrals.
  • State Rebate Laws: Rebates, credits, and commission sharing vary by state; Yowzzer will adjust structure as required.
  • Fair Housing: All activity must comply with federal, state, and local anti‑discrimination laws.
  • Licensing: Brokerage activity is performed by licensed professionals; Yowzzer is a platform, not the broker of record (unless disclosed otherwise in your state).

14. No Guarantee / Market Disclaimer

Yowzzer does not control property values, mortgage rates, market conditions, partner service quality, or transaction timelines. Reward amounts shown in examples (including $1,500 buyer, $1,500 seller, or $5,500 total w/ lender credit) are estimates only.

15. Limitation of Liability

To the fullest extent permitted by law, Yowzzer, its affiliates, and licensors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption. In no event will Yowzzer’s aggregate liability exceed the greater of: (a) the total subscription fees paid to Yowzzer in the prior 12 months, or (b) $100.

16. Indemnification

You agree to defend, indemnify, and hold harmless Yowzzer and its affiliates from any claims arising out of your misuse of the Services, regulatory violations, misstatements to clients, or failure to deliver promised contributions.

17. Termination

Yowzzer may suspend or terminate access for fraud, abuse, non‑payment, regulatory risk, or violation of these Terms. Rewards earned but not yet disbursed may be forfeited if based on fraud or ineligible activity.

18. Dispute Resolution & Arbitration

Most issues can be resolved by contacting us. If not, you agree that disputes will be resolved by binding arbitration on an individual basis in {{GOVERNING_STATE}} unless prohibited by law. No class actions.

19. Electronic Communications & Signatures

By using Yowzzer, you consent to receive notices electronically and to sign agreements (including reward acceptances, partner participation, and disclosures) electronically. Drawn or typed signatures are legally binding to the extent permitted by law.

20. Modifications to Terms

We may update these Terms from time to time. Material changes will be announced via email or in‑platform notice. Continued use after changes means you accept the updated Terms.
